
Wrongfully terminated
A co worker, accused me of abusing a patient. Never did that ever happen on any shift I worked. I believe my Co worker, coerced the patient. The patient, is in the last stage of dementia. The company, I worked for sold the company. This is the new company. The Director Of Nursing, never did a investigation on my shift. At least that's what I've been told.But solely went on word of mouth from another shift, I worked on maybe twice in the 3 years I was with this company. This Co worker, is a work of art. I tell you. I've always went the extra mile when it came to my patients. Lawd, never in 20 plus years. I've been in Health Care .Yes, I had a Union Rep. Do I have grounds to try and get my job back and to clear my name.

Robyn i would say yes their is a chance that you might be able to get your job back but first of all find out all the information u can about what happened and get yourself a lawyer and when u do go bring your lawyer with u but first of all u need to collect everything about incident good luck to you . Being that u r in the Healthcare Field and if u were accused of abusing a patient u will not be able to get another job in the Healthcare Field so i suggest collect all the information u can about the incident and make sure you cover your tracks good luck to you. You can go to the eeoc with ur claim. If thy believe you have a valid complaint thy will start an investigation. If thr investigation leans strongly in yr favor, you will not beed a lawyer, thy will assign one to you at mo cost. If tgy dont think thr is a case but u still want to figgt in court, thy will give u a letter with a right to take action, but without thr support.
You can also find a lawyer to talk with prior to any money being charged to u. I hope this helps.

Robyn, if I were you I would have email my nursing director and document what I said in my book , But make sure you don't violate any Hippi laws and than email it to HR, because word of mouth don't mean anything and than get you a lawyer, but file it with EEOC.

Sometimes we fight so much to prove that we were right but after the fact if you prove yourself right, do you really want to remain in a job that allows bad employees that lie remain in their job?

Try to see if there is a class action suit...or....Start one. If you get three people( (who was wrongfully accused ) with $500.00, that will buy a good lawyer to initiate the lawsuit. If your Lawyer is strong enough, you and your team can settle out of court. Looking into it and DON'T JUST TAKE THAT CRAP...especially the "He said-She said" stuff that employers try to hand out.

As a caregiver I believe that you should lawyer up to clear your name. Your name may be added to a list of abusive caregivers, affecting your ability to get employment in the future. Plus if you do nothing that may even affect your ability to receive unemployment benefits since patient abuse would fall under a rightful termination.
Please at least get an opinion from your union rep and an attorney. Your union may even supply the attorney for you. Good luck.

Get an attorney, Sue the company, the hospital, and the patient personally. The family. Then they will all come clean and point out the instagator.

Go down to your local police department I let them know what you was accused of and let them know you want to take a lie detector test to prove that you are innocent and then take it back to the company this is to protect yourself so you would not lose your license
I agree with mary no. Robyn. This happened to me twice. Did you file for unemployment?. If so they will do their own investigation. A lot of companies are doing this but if determined it was illegal. They will be penalized.
