
Need advice
I have an interview next week. Here's the possible issue that may stop me from getting the job. I have an open WC case for harassment with my current employer, and I have been told it is the norm for the employer to settle and have me resign and leave the company. With knowing this I have been proactive in looking for employement. My question is how do I explain why they cannot Contact my present employer. My fear is they will give me a bad reference which I am pretty sure they will because the suit names the bosses boyfriend as the harasser as well as 2 others.

I said tell truth be honest with them.. So if they do call about employment they will all ready know what's going on.. Give them your three strong reference for them to call.. Pray God is in control..

My experience from working on the HR side is that normally most people don't expect it will be okay to contact their current employer due to the awkwardness. Also many employers because of the fear of getting sued will only give out dates of employment and title. I would just say I prefer you not contact them at this time.

Well Monique, here is my advice in reference on your bad experience, you know we all have something to hide that's for sure, now what is the most important issues for you! To tell the true or to get the job? Me I will get the job, at any cost or go to the unemployment office & speak to an officer of labor your situation they are there to give you a better advice I got one & I am happy!

Just tell them there is a pending case ongoing against them and I'm sure the legal team will state that u aren't allowed to speak of the case.

No prospective employer will expect to be able to call your current employer for a reference! If you end up quitting before you find a new job, I would just act as if you were still there. You DO NOT WANT to tell a prospective employer that you are involved in a lawsuit with your previous/current employer. Hopefully you are not employed in a highly specific industry where your previous employer would know or have reason to be in contact with any possible future employers. You will find yourself what we call "black balled". If it's tight knit industry where your lawsuit could be common knowledge, no employer in that industry is goung to hire you. Please don't think I am trying to be mean or rude. It is very important for you NOT to disclose that, even after you find a new job not only to future employer, but future coworkers.

I agree with Oscar. I would explain that if you were not hired with their company that it could jeapordize your current position. Maybe also, you could refer them to a manager or supervisor that would give you a good reference from the company you are currently working for? Just a thought.

That's a good question. You could just say you are currently working there and would prefer they didn't find out you were looking for something new.
I hear they are not supposed to. But who knows. What is said during that call.
