How long do I have to file a workers comp claim?

I hurt my back last week sorting boxes but I didn’t report anything because I didn’t think it was anything serious. Unfortunately the pain has gotten worse. I called out sick today to go to the emergency room but I’m worried if I will loose my job if the doctor recommends that I take more time off.

I hope everything worked out OK with your back and your job. Can you update us for everyone's benefit and education?

call your manager and tell him/her you hurt your back at work and are unable to do the mandatory job requirements. file a workers incident claim and go from their, continuing going to work may worsen your back so don't take a chance.

The Statute of Limitations is different for each state, but if it happened last week, you're fine. Report the incident to your employer ASAP. The longer you wait, the more suspect your claim becomes. It is illegal for an employer to terminate your employment because you made a Worker's Comp claim. Make sure any doctor you go to is told that the injury occurred at work. Your employer generally has the right to tell you where to go for treatment if they choose to do so.

Each State is different as far as Laws etc. Your issue is fairly common as per not realizing you were hurt until a few days later. Report your injury to your HR Department ASAP I'm sure they will tell you that if it happens again to report it immediately even if you don't feel any pain for this specific reason especially. Back injuries are sneaky. Good Luck!

Depends on the state. Once the condition causes you to miss work, you should let your employer know asap. Delays can cause problems for you and the employer. Cheryl's right - once you miss work, call your job right away!

I believe it's different for each state but if your injury occured within the last week you should be okay. Don't wait...call UR job 2day.
