i lost my job cause of work comp that i didnt sign up for

I got hurt on my job so my Dr took me out of work for 3 or 4 days. So the very day i turn in my excuses to HR to let them know I will be outta work n what day I will return back. So when i did return back to work I had to see the company Dr n take a drug test before returning to work that night. OK no problem I pass everything. So a month later the company saying something about work comp that the safely man put me on n the company had to pay for my medical bill which it wasn't much cause I went to the ER but they didn't pay me in pocket. I didn't even sign up for work comp or anything. They fired me 4 days before Christmas. It should be against a law to fired anyone if they get hurt on their job or for any unnecessary reasons. If I did sign up for work comp which I didn't I should be able still have a job. It wasn't my fault.I work everyday didn't miss not one day, had sick days n all I had my own insurance also. I been at this company for 1 year. Not fair at all. I was a good employee. Days before Christmas they fired me.

When you get hurt, it should be reported immediately. Usually you also provide an immediate written statement as to what happened. They have a local care provider selected that would see you for claims. Your doctor may not be able to “excuse” or pardon you from work as you would be required to see a doctor of their choosing. Since the injury occurred at work, your employer is liable if you reported it in a timely manner. Being sent for a drug testing doesn’t make a ton of sense unless they were suspicious about something. Provide more transparency as they probably had witnesses that saw/reported something different. Perhaps video was reviewed and painted a different picture. Keep your head up and hope you have a speedy recovery

Employees don't "sign up" for Worker's Compensation. In my state, an injured worker is REQUIRED to see a medical professional of the employer's choosing....not one of their own choosing. Something about your story is very confusing and convoluted.

It is against the law to fire someone who has filed workers compensation. You are entitled to the benefit because you got hurt on the job. Did they state that was the reason for dismissal? If so, you need to get an attorney and sue them.

It is against the law to fire someone over workman's comp and they got injured on the job. Consult with an attorney and Sue them if you have a case.

It is against the law to fire you when you got hurt on their property. You should talk to a workman’s comp lawyer. Every company that has over x amount of employees has to have workman’s Comp insurance, it’s the law.

I’m not sure what state you reside in but realistically you have to understand that if you don’t have FMLA/LOA or a workers compensation claim setup to protect you against situations like this it explains why you were terminated.

In states like California there is a law that allows someone to be out (sick) for three days and on the fourth day a doctor’s note is needed during which FMLA/LOA would be required if you’re to be out for more than five days. Because you didn’t have setup FMLA/LOA in place to protect you the employer can legally terminate you, and in this case the timing just happened to occur days before Christmas.

It’s often that many people don’t bother researching or learning about FMLA/LOA or workers compensation claim upon or during employment and then assume the employer is supposed to hold one’s position until one returns.

While it’s understandable that you were injured on the job there should’ve been workers compensation claims paperwork that you should’ve completed that day in which your employer would’ve sent you to the doctor with the proper paperwork needed. If the doctor took you off work afterwards this would’ve been where that paperwork would be sent back to your employer with a date of return. A doctor’s note is simply not sufficient enough for time off without the workers compensation paperwork submitted as well.

I’m sorry you were terminated and the decision to fight it is entirely up to you. However, moving forward you should research FMLA/LOA and Workers Compensation information so that you’re more knowledgeable and protected in future employment.

What they sis is against the law. You really need to get lawyer. If all of your paper work is legit, your case would be acceptable. You have an opportunity, now if you don't know that you have been blessed in disguise. You will blow it. I know you have a case if what you say is true.

If you in GA or FLA the best thing to is look over you paperwork in if you did not sign up for that go get a lawyer. But look over all your paperwork and everything cause some company's will ride over you .

I don’t know what state your in but in Maryland they can fire you if they wake up on the wrong side of bed bro real talk I just lost my job after working 5 years after I got hurt list my finger was out for 3 months then I returned then 1 week after they used that I was lookin at my phone they call it company gross lost I can’t sued them but I can file a workers comp settlement

Get a lawyer. Because your company sends you to there doctor before you get to workmans comp. Im in florida. First if you dont mind did you tell them about the incident. Because its there job to have you sign papers to go to the E.R. Then there next step tbey are supposed to give you the number for workmans comp. I dont know how it is in South Carolina but I will say GET YOU A LAWYER QUICKLY. GOD WILL LEAD WHERE TO GO DONT KET THEM GET AWAY WITH THIS! PLEASE
