When Employers Black List Employees

I have been in the HVAC industry for over 30 years and have 2 Licenses and many Certifications for AC ,Refrigeration, Electrical and Plumbing and I have made lots of money for the companies I worked for , But because I stand up and demanded that I be treated fairly by my Employers ,they ( or some of them) have Black listed me, I know because I had an investigation done and had to threatened a Cist and desist to one of them for false information given to the Co. I got to do the investigation. needless to say this Black listing is still in place and is affecting my employment .Be a where that your lack of employment might not be a lack of your skills ,but Bad information systemically put in place to negatively affect who you really are as an employee.

This is why before I raise any questions to my employer, I ask for a performance review or recommendation. This way when the pricks turn on you after you point out their mistakes, you have proof for a lawsuit. They look pretty stupid in unemployment tribunals and civil court when you have proof you were a ideal employee up an to the point they dismissed when you challenged their actions. I work in law enforcement where you have no employment rights. When they do a background they can get away with asking questions you would be protected from legally as a private worker. As well as they use back channels and violate many HR tenets to ask questions about you former employers should not answer legally.

Winston,

First let me congratulate you on standing up for yourself.

The only thing I would have to write is that sometimes BEFORE standing up for yourself, you need to first weigh all your options. Let me explain.

Yes you should be treated fairly, but sometimes you have to weigh options and choose which battles to fight for at that moment. Sometimes the thought of being blacklisted does not often cross any employee mindset. Most of the time it’s just making a stand for what’s right. I know the feeling and it’s one that I have seen too many employees experience.

Weighing the options should be based on if anything happened. Would you be able to handle potential negative outcome? Most of the time there will be some type of backlash...ones you can fight and others you have to just take a hit from. In your case it is being blacklisted.

The only recourse of action would be proof, which is sometimes hard to get. From your post, it seems as though you have already left the job. Proof is having individuals contact the past employer and make it seem as though it is for a potential future job opportunity. When the call is made, have the Individual record the conversation. FYI: look up state laws on recording conversations. Sometimes all it take is at least one person knowing that the conversation is being recorded. You can also announce the the conversation is being recorded, but his method can make the Individual watch what they say or just hang up.

Either way, you can get proof if you do this correctly. Also, see an outside attorney to help advise you if your options. Also, contact your local employment office and speak with someone and let them know what your situation is. They may have someone in office that could help with your situation as well.

Furthermore, try various websites and local agencies for employment. Not everyone tolerates the act of being blacklisted.

It’s sounds like your only option is to hire a GOOD employment Atty. Blacklisting if done through no fault of your own is illegal. A good Atty will be able to prove this and that shouldn’t be that difficult. I understand it won’t be cheap. The other obvious alternative is to stop making money for others and go it alone.

Very true im getting done tje same way for as we speak now man i have 15 uears experience with l plumbing and i work at prichard water and serwer for 9 of tjem and this lady nia bradley and her city council friends is black listing me so very true thought i was alone

They do the same thing to people that become injured on the job. After workers comp is close to it’s end and they find out you are still not well or you hired an attorney your through. No businesses will ever hire you even if you prove that a surgical procedure helped or fixed the problem. Companies are all linked together through workers comp. and the companies will look at their records, and they will let them for money, you will never be able to prove anything. Think about that. Now I was injured bad enough that I was able to apply for SSDI and that took several months and a great attorney.
