I was wondering if employee files are considered to be joint property? I am in need of my last performance annual evaluation only. I didn't know if since I had to sign it, if it is company property.

If your employer is having a difficult time giving you a copy of your last review, it's time to get a new employer. It is a signed legal document, just like a patient's chart. If a patient wanted a copy of the chart one would be made. All we could do is charge for the paper (usually at $0.25 per page to cover all overhead).

Go to your HR department and ask for a copy of the review. If they say your manager has it, then go to your manager. If either of them refuse, ask them to write down the reason they refuse to give you a copy of your review. It doesn't mater why you want it, just that you want it should be good enough.

If you want to play nice at first, you could say, "I would like to have a copy of my review so I can remind myself what I need to work on in order to improve my work processes" or something to that effect. But there is no excuse for them not giving you a copy. That is a legal document regarding you, and you have a right to that information because it helps dictate how the organization views you.

Contact your state labor board, they will give you better guidance.
