Short-term Disability

What should I do, I was out on short term disability and my first surgery did not fIx the problem and am still in a lot of discomfort, my primary care physician and I discussed the options and since I had already asked HR about any type of light duty work prior to me going out on leave and she said NO, so we extended my leave of absence until even more testing could be done, I dropped off the note and the day after I was to return , I was called and told I didn't have a job anymore, I live in Washington state and worked in a Call center, now I am unable to also receive unemployment benefits, unless I want Ro fight with them. The company I was working for is a worldwide business. What is this world coming to when a call center can not hold your job, when this one happens to have a large turnover, McDonald's pays more than these people.

I would get in touch with a lawyer ASAP. I would also reach out to any other people who may have been terminated without notice. If this is a large company, I am sure they have done this before. You could be looking at an out of court settlement or Class Action Lawsuit depending on the severity of the termination and if more people were involved.

If they say you were terminated, you should get a written letter stating reason. If they say you quit, which they often will to avoid paying unemployment expenses, you should notify unemployment department and lawyer. If you demand to return back to work because you didn't quit and they didn't fire you, and they say no, they just committed a crime.

  1. Disability is a protected class and they cannot fire you on the basis of a Short Term Disability.
  2. Show proof of disability by doctors letter and provide to Human Resources to state your defense and have it on record.
  3. Always keep a timeline of your conversations with HR, Management, Doctor.
  4. If you can prove you were terminated because of your disability, you basically have won your case.
  5. The average discrimination settlement often exceeds 6 figures.
  6. They really messed up if what you say is true.
