I applied at J.C. Penny for Retail Sales Associate and the application asks for DOB. I was told that they are not supposed to ask for this unless you are hired. I feel this is why they haven't called me. People trying to run this country are in my age group and it's a very hard job. The job I'm applying for is not hard, but they think I'm too old. I am a senior in good health and I need to work; I can't stand being idle.

They can't ask this during an interview but they can on an application. Unfortunately age discrimination is still prevalent and mostly allowed. Vote TRUMP. After he kicks out all the millions of illegals there will be jobs for Americans again and they won't be able to play these games.

Unfortunately, it is not illegal. My hope is you are NOT a victim of age discrimination as opposed to simply getting "lost" in the competitiveness of seasonal hiring.Have you followed up with the Hr department at the store to inquire about your application? Do you have a Macy's near where you live? In my area the associates in all areas of the store seem to be of maturity, in fact it is the millennials who feel they cannot obtain employment there, go figure. I pray you find something you will love doing and that you find it soon...

Not illegal . Its part of the process without it it won't go through. Jcpenney can't see the DOB. at store level. If you didn't pass the test or questions that is at end of application it won't load to the store .

It's illegal discriminate on age but you have to prove it. I'm 56 with over 39 years in computer 36 in networking alone. I been around before the Certs were crated. you think i have job offer all over the place.. Age is a big deal as we 20 and 30 something that hate anyone over 45. And other have no clue to who hire but paper techs.

what you are first time applicant .First thing in each application are name ,last name ,DOB,physical address and phone number .

You can leave it blank. You are right that they cannot ask you that until you are hired.

Most applications ask date of birth... It is not illegal. keep head up they may call :)

EEOC: Generally, age is considered not to be relevant in most hiring decisions, and therefore, date-of-birth questions are improper. Both employers and employees should be aware that age is a very sensitive pre-employment question. As such, the Age Discrimination in Employment Act protects employees 40 years of age and above. It is permissible to ask an applicant to state his or her age if he or she is less than 18. If an employer needs the date of birth for internal reasons, i.e., computations with respect to a pension or profit-sharing plan, this information can be obtained after the person is hired.
