
Got Slanders by the account manager
I was accused of using the actual "F" word, while under pressure, to meet the dead line, since the manager on duty refused to answer his office line and his cell phone when his help was needed. I was removed from my position to another position, stating that I needed to learn how to be a better employee by stop cussing, and I would be send back to my regular position. The two employees names that were on the write up, confronted me 3 weeks later, to oboligize about what had happened to me, and had asked the account manager to bring me back, because they were both were stressed out that night, and they felt it was over with the next day. One of them complained about me using the F word. The account manager wont do that, it's been 2 months. A week ago, they both told me that they didn't tell the manager that I used the F word toward them over the phone throughout the day. This tells me that the account manager had lied about what was said, and made it look a lot bigger than it was. I have involved HR manager, hes waiting for the 2 managers to come back from their vacation to find out why they had lied.
I have a written note from the two employees stating that they did not hear me using the actual F word, toward them, as well as I did not repeatedly calling them and cuss them .
Can I file a lawsuit against my employer for slandering me, ruing my name ? Everyone that works there know that Im not that of person that cuss when Im under pressure. There is more to the story, but this is the main part. live in California Thank you. Dan
If the state of California is a HIRE at WILL state like my state of Connecticut, then your employer has the right to terminate you from your job at any time, for any reason.
This holds true for the employee as well. You have the right to leave your position at any time for any reason.
HR departments for the most remain neutral in situations, they are, or suppose to be the judge, they look at documentation, they look at the case information, and apply the employee book of standards to the person who is being evaluated. (this all depends on the size of the company and what they do)
Understand that the HR department will do everything they can to prevent you from collecting unemployment benefits. By an employee being able to collect only drives up the cost of the fees that an employer must pay to the state. Its much like an insurance ... have an accident your rates go up...
HR will document everything in order to protect themselves. Remember
You are entitled to a copy of your HR records You are entitled to submit any documentation to HR to defend yourself You are entitled to sue your employer for any reason...but I would speak to an attorney who specializes in employer/employee laws they will could tell you if you really have a case that could win or not
If you still have your job, then submit your proof, be quiet, and do the best job you can and keep a positive attitude.
