
I got fired and I think it was wrong
I got fired because of my performance. I'm a PBX operator and answering fast is my job. The job is at a cancer center and they bend your ear if you let them! Coming off my honeymoon, I get called into the office and get told my call report for last month was horrible! I took the last amount of calls for the entire month and made busy so many times, they feel I robbed the company of money! Duh, I do get a paycheck from you guys right? Anyway, is there something I can do to save face or let corporate know what's going on? The paper I signed states I didn't have any extra duties that would make me busy our so much. My supervisor had me and my other operators preform medical records duties; stating"you're just answering the phone, you have time to do it." I feel like filing a grievance and fighting until corporate hears me! Somebody help me out...

If I understand you, your supervisor terminated your employment for not taking enough calls and had you sign something that said you didn't have other duties when you did, is that correct?
First question is: do you have a union? That's where you'd file a grievance. If not, then you would have to go through the state labor board. It might be a little more difficult if you signed a fraudulent statement.
Second question: is do you live in an "at will" state? It doesn't really matter because they gave you a reason that you can argue but "at will" states tend to be less responsive.
Also, did you get a copy of the paperwork? If not you'll want to be very careful. In any case I wouldn't try to talk to the Corporation. Even if he was overstepping his bounds and corporate rules, they will protect themselves from a lawsuit. You don't want them to know what you're doing until it's done.
If you pursue this you have to be very specific as to what exactly they did wrong. If you go to the labor board, be sure to have your ducks in a row. Bring all documentation, a written statement that completely outlines why it was a wrongful termination and preferably names and and contact info from co-workers that can corroborate your story.
Lastly, you should be clear with yourself as to what you want. You probably won't get your job back, but you can have them clear your record or you can sue them, etc. You need to present your case with that end in mind so that it makes sense to whomever might look at it as an outsider. Otherwise it probably won't go very far.

You can call an attorney for wrongful termination but if its at will job they can fire you for any reason. How i look at it..is that you dont want to work for a place that your not wanted . It seems there are unfair practices and that type of pressure consistantly is not a great environment to work for. You want to wake up wanting to go to work not dread and worry if your job is on edge.and.you have to fight to stay employed. Sometimes change is good, when your fighting for something that has no purpose in your life. One door closes and another opportunity is much better and a positive environment. You'll be much happier and able to move on. It doesnt make sense that you had no warning, you got married, went on a honeymoon, only to find out they back stabbed you behind your back. You come back to work, surprised and wondering what you did wrong ? You didnt do anything wring, they are just not nice people. Honestly, they did you a big favor, your too good for this company !! You deserve better, Thank them and move on. Looks like alot of internal management problems to me.
My advise, dont waste your time, your time is more valuable. Spend time looking for a better job, clean up your resume or have a professional company do one for you . Best of luck.!!

You should consult an employment attorney. You can get a referral through your local Bar Association for a small consulting fee. Here in SF the referral fee is $45.00. It is well worth it to see if you have a case for wrongful termination or not. The other thing is do you have any witnesses that will back you up regarding the extra work you performed that was not part of your job? If you can get a signed statement from them and bring it to your attorney that may be enough amo to go after your former employer. You need to be clear on what end result you are seeking. Do you want your job back or do you want some sort of severance pay. Good luck!
Ok y'all. So I'm appealing my unemployment. But I think CCCN my last employer is saying something to the companies I'm applying to. I applied for a PBX Operator position at a hospital. I didn't get selected. I used to work at a damn hospital! Sorry for the language, I'm a little upset. I'm really really thinking of getting a lawyer. Any suggestions? What can they say about your separation? Can they say I was fired for performance etc?
