
Wrongfully Terminated.
So I recently went inpatient for mental health. I notified my work a day before I would make this decision. Then I get out and I tell them I am ready to work in a couple of weeks and they decide to fire me because of this. What can I do about this? About being wrongfully terminated?

So sorry that happened to you~ I suggest contacting EEOC and file for UE as well as consult a lawyer, many lawyers have a free one time consultation prior to retaining them if needed. If you live in an At Will Work State don't use the term Wrongfully Terminated in an At Will Work State there is no situation viewed as wrongfully termination. The employer can terminate you at anytime or you can quit at anytime for no reason. However if you can prove they let you go because you went inpatient for mental health that is discrimination according to the American Disabilities Act. You may want to contact the US Department of Labor. If you have worked long enough to draw unemployment when you file on the application where you are asked for what reason was you let go. Answer "different of opinion with supervisor. or management." Hope this helps.

Hi Ariel, depending on which state you live in, If you are employed at will, your employer does not need good cause to fire you. In every state but Montana (which protects employees who have completed an initial "probationary period" from being fired without cause), employers are free to adopt at-will employment policies, and many of them have.

I think it was wrong to fire you because you told them and you had hospital records. i went though the same thing and my job was very understanding. All got to say is keep your head up, and call a lawyer and see what they say. I HOPE YOU ARE DOING WELL, because i have mental health issue myself . you just be strong and don't give up.

Mental illness falls under a protected class. I would not usually say this because in cases of sexism or racism, it's harder to prove, but you might want to talk to a pro bono lawyer. You cannot be let go for mental illness related episodes or treatment. I would suggest you find a legal clinic and just talk it over with someone from a legal point of view.

Bottom line is did you communicate prior to treatment? I knew about a month ahead of time that I was going to have surgery and require work off to recover. Point is: Communicate as soon as you know! Unless you were in a life threatening position and admitted immediately, you're given notice.
I am glad you are doing better. The can not fire you. That is discrimination.. You told them what was ging on with you and nothing was said. Go over their heads to the head of HR and tell him/ or her bout it. If they do nothing go to free Legal Zoom on your computer and they can help you. Or notify the Beter Business Bureau or a civil defense attorney. You need this not to be so stressful for you and be upfront with who ever you talk with. You are a brave woman and your employers couldn't wait until you got out? Have they already replaced you? If so the more ammo you have on your side. Good Luck and keep on keeping on.
