
Wrongful termination
I was working at A living Assisting as a care giver .. One of the residents there asked me if I would go to the store for them I told her yes but it would have to be when I get off from work ..she gave me 100.00 dollar bill I then told her that i needed to write a statement that she is giving me the 100.00 I then asked the receptionist at the front desk to be my witness and she agreed to sign so myself and the lady I went to the store and the reception signed .. I went and pick up her items and showed the receipt and change to the reception.. I then returned the money to the elderly and she thank me for going and gave me 20 bucks and that was July 12 .. I was off a few days 17th 18th 19th I went in on the 20th but was not feeling well so thy sent me home I had off on the 21 so had a break ..I then returned back to work on July 22 I was told by some of the girls that some of the residents have been missing some things and someone had money stolen on the 18th and a few other things One of the elders had their wallet stolen someone went to Walmart and spent over $500. Now keep in mind when all the stuff was happening I was off all those days when things were missing. I got a call from my supervisor July 23 . Saying there is an ongoing investigation and I need you to stay out a few days I said OK. At that time I did not get upset because there's nothing that I did wrong so I went about my day. I was told by one of the other girls that there was a " white women .there and she was suspended for three days that following Monday they let her return back to work .. I got a call Tuesday the 25th from the supervisor stating this I told you there was an ongoing investigation I am terminating you because you went to the store for a resident she did and said you can come get your last check and sign some people work I said no you can mail me my check. I think got off the phone and went in that in the handbook to see if I did something wrong meaning was it OK for me to go to the store on my time off so I looked through the handbook and it said nothing. So I called the supervisor back and told her it does not state in the handbook if I can or cannot go to the store for resident on my time off she stated I don't tolerate it and then I said well it doesn't say she got very nasty with me and hung up the phone .. I then called to find a consistency lawyer to file a claim for California state law says that the job that I work that is a at will job.. meaning that they can fire me for any reason I feel the real reason why she fired me is because she thought I stored from the residence and I didn't I didn't have to .. I was very devastated I am a good caregiver I took very good care of those people there it was over 87 people .. I have a strong faith in God and I feel he removed me from that place for reason God did not create me to worry he did not create me to fear he created me to worship him .. also keep in mind that they found the person on video at Walmart and it was not even anyone that work there ..I am black
Oh my goodness - I'm so sorry this happened to you Marguerite! That really is terrible. That is the unfortunate thing about working in at-will states, but it would be great if managers would actually look into things further and not just make things up.
