Maternity Leave

My husband and I found out I was pregnant in May. We were due in November. We found out that I had Gestational Diabetes and high really high blood pressure. My doctor put me on a time restriction with me only being able to work 6 hours at the most. My manager made the comments that if anything happens to me reguarding my job or my baby's health, that it is not her problem because she didnt tell me to get pregnant. With that being said, the hospital that I work for terminated me while I was out on Materniry Leave. No one stayed in contact with me and when I took my Drs note having the date that I was to return to work, that was when the guy from HR told me that I was termintated.

These people didn't really care about you if they said they didn't tell you to get pregnant. It was none of their business anyways.

Recovering Lower Back Injury Spine Surgery 3 2016 Present at Hughes Research Lab

You know a similar thing happened to me. I had a spinal injury and had to have extensive back surgery, else I would have been paralyzed or worse. It was a close call really, but my neurosurgeon is totally brilliant, and he saved me.

I went out on Short Term Disability, which was pre-approved. to have the surgery and recovery period. Two weeks into recovery my employer called me and asked if I was ready to return to work..Of course I was not, so I got a letter from HR saying I had been terminated. The client could not wait for me to return it seems.

It was weird, they tried to say I had been terminated the day I had the surgery, when they had already approved and paid for my sick leave since then.

I really did not care, since I work in an AT WILL state. The company WAS kind of nasty throughout, they acted like I had been injured just to spite them, and my rep even accused me of going to surgery just because I had disability benefits. So your comment about your supervisor smarting off is similar.

But the law is big on FMLA so maybe you can get some legal redress. It looks like you played by the rules, and it looks like it was just spite on their part. I hope you post again your luck in dealing with these creeps.Frankly it seems outrageous to fire a woman for giving birth. Good Luck

Wow, This is definitely wrong, God forbid if they were in the same situation they would not like it as well. They are human rights, and labor laws check them out.

Yes I agree you have to contact the EEOC Office and have them review your case. Most likely their attorneys will represent you at your State Labor Board. Sorry that you had to be treated this way. All the best luck.

You have rights under the Family Medical Leave Act. As I understand it, if you go out on an approved FMLA absence you have job restoration rights.
