So i was terminated from my position as shift manager at the local fast food here for a simple mistake and have tons of questions what to do. In the handbook it says that if a manager makes a mistake then they could be put on a probatiin period to help them with goals to help them succeed but i was not offered that. Plus before being terminated i was entitled to 5 days vacation pay but now they are stating that since i was terminated i am no longer entitled to that although i worked the full year for that vacation pay and now their not trying to give it to me and when i ask where in the handbook it stated this all they say is that it does not state it and its up to the owners discretion so what are handbooks for if they dont put these things in their???
They cant take what belongs to you. I will keep you in prayer that they release what is yours. And get rid of who had you fired. Its always someone jealous and want your position. Let God bless you with something better because you deserve better. It was there mistake for firing you anyway. Keep your head up God will fight this for you. And He always wins. Ok, they are correct about that it happened to me. But here is the problem you have the right to file an appeal to the HR if you have one. Ask the why and how can you fire me without going through all of the stuff that was suppose to be in the handbook. Do not let it go without putting up a good fight about the issue, to me it sounds like some BS just my opinion. Keep me informed, please.
I would look into my unemployment compensation, find a temp agency look to see if it is a way to go back to school research some self-employment opportunities and stay positive.

Thank you guys. I plan on really looking at the handbook over and over and going to take it to the labor board. Theirs a little back story that i didnt put out their but i feel like i was discriminated against though so i dont plan on letting them get away with the things they do and have done. Now to ask a serious question... how can someone find a legitimate job working at home?? Does anyone know where i can possibly try by any chance?
Hi Michelle Diaz - I am so sorry to hear that. It's always tough to lose a job.
I think the probation period is definitely up to their discretion, especially if you live in an at-will employment state.
However, I am reasonably sure that the vacation pay you worked so hard for is something they are legally required to pay you.. I am not certain on this, so don't quote me on it. I would reach out to your local labor board and ask them this, as they would be able to tell you for sure.

Hi Michelle Diaz , NY is one of those states where there isn't a federal mandate that requires employers to pay employees for PTO when there's a separation of employment. In NY state PTO is extended only when it exist within the term of the employment contract and your boss may be looking at the employee handbook as more of a guide than a contract. 5 days pay is a significant amount of money so you should get to understand your right and learn what action options are available. Start off by filing a claim for PTO wages at the DOL website and search for local city/state claim filing options available to you in NY . Some companies do not pay out the vacation time accrued, there is no law saying that they have to unless the handbook states otherwise.They have to follow what is in the handbook. If you feel that they are not following what is in the handbook you may contact the Department of Labor or EEOC for assistance. Its unfortunate that they fired you, their loss. Keep moving forward. Seek to get your payout for vacation and apply for unemployment.
