
I applied for a job. I had to go through clearance. (Physical, drug test, finger printing etc….) I did everything I needed to do. 3 days later I got a call to start training! I was happy, I got the job!! After 2 weeks of training, I started working. Everything was GREAT! But then… A few months later I was terminated! They said something showed up on my background check! Mind you, these were back in my younger days. They all been dismissed/expunged back in 2011! Now my question is… was I wrongfully terminated? Why would they call and hire me, if I wasn’t in the clear yet? Wouldn’t it be best if they waited for my background check results to come in before they call me to come in for an interview and before I start training? YES. they must be full of it. if it didn't show up before how they show up now? they just wanted to fire you ,used that as an excuse. file for unemployment asap.

Employers are allowed to have you start before the background is complete making it a contingency offer. What that means is if any adverse results are found they can retract the offer. Also the concerning part is not the employer what concerns me is if in fact your record has been expunged it should not show up in the first place. However if it has only been dismissed it can still and will show up. You have to go through a formal process to have the dismissal charges removed from your criminal history. I would start in that area. Contact your local criminal bureau of investigations for answers and you may have to hire a lawyer for the removal process. Government agencies are not t00 keen on providing statues that will remove the dismal and processes to remove criminal history and may, very well, refer you back to a lawyer. I hope this helps.

They should have cleared you with a background check first. A bad record follow's you forever. I do not understand why they let you work for " months". I do not know what kind of a job or a store you worked at. they may have used you to fill positions at the holidays then let you go.

Hire a lawyer and go after them. If they pulled expunged records you can go after the government


I’d ask for copy of your criminal report just to make sure you are still not showing up on it. Or if the report belongs to someone else. These things can be tricky.

If you are at “at will state” they can terminate you at any time as you can quit at any time as well.

If you didn’t disclose on your application that there was “something” that “showed up”, you were not completely honest when you filled out the application. In this case the employer could terminate you. If your record was dismissed/expunged it should not show up on your background check. I’ve found that it’s better if you are up front with the employer if there is anything that “might” pop up. You can explain in person at the time of your interview, what occurred when you were younger. That way the employer is not surprised if something pops out after you’ve had your interview. Lesson learned.

If you got paid for the "few months" of work that you did before they fired you for having a record then they didn't use you. You used them for a paycheck knowing you had a record from the past. Good luck to you. Depending on the state you live in some states do not have to even give you a reason. States like Florida, which is a right to work state, can fire you whenever they want just because they don't like the color of your hair. They don't need to explain
