On November 5th 2019 I was fired from a job that I held for 13 years. The company said I was being Fired due to work place violence but I only had an argument with a co-worker that I never got violent and the co-worker said he never felt threaten. I have an arbitration hearing on February 6, 2020 and just want some advice on how to act or what to say during this hearing that might get my job back.
Depends on your Union. I was a Union official didn't help me but my third step is 04/24. I always told members not to speak unless necessary and let the union or lawyer in an arbitration speak for you. New York is an "at will state". They can fire you for no reason. Wrongful termination cases, you need to prove there was discrimination from your employer based on race, religion sexual preference, gender, age, disability etc.

I have been in your situation a few times myself so let me try to relate what I did.Although I get aggravated and sometimes let it get the best of me I just try to remember that the other person is entitled to their opinion and remain humble because I'm strong enough to not let my emotions control my actions.also not feeling like I'm the victim because I have great people who raised me right. Did you hire an attorney? You should have access to all your records. The attorney will have much more success in getting everything! Having a job this long??? And the fact that the co- worker stated he never felt threatened can be YOUR witness!! Stay calm, professional, and dont play into how they will try to make you look bad by getting a response that might show anger issues!! Good luck and kick ass!!
I have a friend having same problem. I feel so angry but yet. I can not do anything at all. He all way doing good job. He never leave anything behind.
Jules, my advice is to stay calm at arbitration hearing, do not get emotional , answer questions in simple language, no long stories if ask what day is today,?just say March, 22nd, do not elaborate , remember the management hold 51% . possible 3rd who heard the argument and got offended or scared! Speaking from previous experience in regard to this scenario I am in agreement with Cynthia. The lack of the employer in offering another form of resolution at the time may possibly indicate they would actively seek other issues to terminate anyhow.
